SECTION 1 - OVERVIEW AND ACCEPTANCE OF TERMS

Welcome to troutcreeksoaps. The terms "we," "us," and "our" refer to troutcreeksoaps and its owners, operators, agents, and assigns. troutcreeksoaps operates this website and online store, including all related information, content, features, tools, products, and services (collectively, the "Services") in order to provide you, the customer, with a shopping experience for handcrafted soap and related products. troutcreeksoaps is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (collectively, "Terms"), constitute a legally binding agreement between you and troutcreeksoaps governing your access to and use of the Services and your purchase of any products offered through the Services. These Terms include important information about your legal rights, including warranty disclaimers, limitations of liability, a binding forum selection clause, allergen and ingredient disclosures, and a class action waiver.

By visiting, browsing, interacting with, or using the Services in any manner, or by placing an order for any product, you represent that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of a business or other entity, you represent and warrant that you have authority to bind that entity to these Terms, and "you" refers to both you individually and that entity.

SECTION 2 - HANDCRAFTED PRODUCT DISCLAIMER AND VARIATION NOTICE

troutcreeksoaps products are handcrafted in small batches using natural ingredients. By their very nature, handcrafted products exhibit variation from batch to batch and from unit to unit. You expressly acknowledge and agree to the following:

(a) Color, texture, appearance, scent intensity, weight, size, and surface characteristics of each product may vary from product images displayed on our website, from prior purchases you have made, and from other units within the same or different batches. Such variation is inherent to the handcrafted nature of the product and does not constitute a defect, breach of warranty, or grounds for return or refund absent a separate written agreement.

(b) Because our products are made by hand using natural oils, butters, botanical ingredients, and other naturally sourced materials, slight imperfections, color variations, air bubbles, surface texture irregularities, scent variations, and other aesthetic differences may exist between individual units and between batches. These variations are a normal and expected characteristic of handcrafted goods.

(c) Product images on our website are representative only and are provided for illustrative purposes. We do not warrant that the appearance, color, size, scent, or any other characteristic of any product will match any image, description, or prior purchase.

(d) troutcreeksoaps makes no representation or warranty that any two units of the same product will be identical, and you waive any claim arising from natural variation inherent to handcrafted production.

SECTION 3 - INGREDIENT DISCLOSURE: ANIMAL-DERIVED INGREDIENTS AND RELIGIOUS DIETARY NOTICE

IMPORTANT: TROUTCREEKSOAPS PRODUCTS MAY CONTAIN PORK-DERIVED INGREDIENTS AND OTHER ANIMAL-DERIVED INGREDIENTS INCLUDING BUT NOT LIMITED TO LARD, TALLOW, ANIMAL FATS, AND THEIR DERIVATIVES. THESE INGREDIENTS ARE CLEARLY DISCLOSED IN THE INGREDIENT LIST FOR EACH APPLICABLE PRODUCT.

(a) Pork and Animal-Derived Ingredients. One or more of our products contain ingredients derived from pigs (porcine-derived ingredients), including but not limited to lard (rendered pork fat), as well as ingredients derived from other animals, including but not limited to beef tallow and other animal-derived fats, oils, and byproducts. These ingredients are used in the formulation of our soap products.

(b) Religious and Dietary Restrictions. If your religious beliefs, dietary practices, cultural practices, or personal preferences prohibit or restrict contact with pork-derived products, animal-derived products, or products of animal origin, including but not limited to restrictions observed under Islamic law (halal requirements), Jewish law (kosher requirements), Hindu dietary law, vegetarian practices, vegan practices, or any other religious, cultural, or ethical framework, you are solely responsible for reviewing the complete ingredient list for each product prior to purchase and use. troutcreeksoaps makes no representation that any of its products are halal, kosher, vegan, vegetarian, or free of animal-derived ingredients unless expressly and specifically stated in writing on the product listing.

(c) By completing a purchase, you represent and warrant that you have reviewed the ingredient list for each product you are purchasing and have independently determined that the product is suitable for your personal use, religious observance, dietary practice, and any other applicable restriction or requirement. troutcreeksoaps shall not be liable for any claim, loss, damage, harm, offense, or injury arising from a customer's failure to review product ingredients prior to purchase or use.

(d) Ingredient information is provided in each product listing. You are encouraged to contact us at troutcreeksoaps@gmail.com prior to purchasing if you have questions about specific ingredients in any product.

SECTION 4 - ALLERGEN DISCLOSURE AND PRODUCT SAFETY WARNING

IMPORTANT: OUR PRODUCTS CONTAIN INGREDIENTS THAT MAY CAUSE ALLERGIC REACTIONS, SKIN IRRITATION, SENSITIZATION, OR OTHER ADVERSE EFFECTS IN SOME INDIVIDUALS. READ ALL INGREDIENT INFORMATION CAREFULLY BEFORE USE.

(a) Common Allergens and Sensitizers. troutcreeksoaps products may contain one or more of the following, which are known allergens or sensitizers in some individuals: natural plant oils (including but not limited to coconut oil, palm oil, olive oil, castor oil, sweet almond oil, grapeseed oil, and others); animal-derived fats (including lard and tallow); sodium hydroxide (lye) or potassium hydroxide used in the saponification process; fragrance oils and/or essential oils, which may contain naturally occurring fragrance allergens; colorants, micas, oxides, and other cosmetic colorants; botanical additives, herbs, clays, and other natural materials; preservatives and stabilizers.

(b) Fragrance Allergens. Our products may contain fragrance components that are known or suspected allergens under international cosmetic regulations, including those identified by the European Union's Scientific Committee on Consumer Safety (SCCS) and those anticipated to be covered under the United States Modernization of Cosmetics Regulation Act of 2022 (MoCRA) fragrance allergen labeling requirements currently in rulemaking. Specific fragrance allergen information is disclosed on applicable product listings to the extent required by applicable law.

(c) Lye Safety Notice. All of our soap products are made using lye (sodium hydroxide or potassium hydroxide) as part of the saponification process. When soap is properly made and fully cured, no free lye remains in the finished product. However, if you have known sensitivity to any of the base ingredients, including the saponified oils present in finished soap, you should consult with a dermatologist or healthcare provider before use.

(d) Patch Testing. We strongly recommend that all customers perform a patch test before using any new product, particularly customers with sensitive skin, known allergies, eczema, psoriasis, rosacea, or other skin conditions. Apply a small amount of product to the inside of the wrist or forearm and wait 24 to 48 hours before full use. If redness, itching, burning, swelling, rash, hives, or any other adverse reaction occurs, discontinue use immediately and consult a healthcare provider.

(e) Discontinue Use. If any adverse skin reaction, allergic reaction, or other adverse health event occurs during or after use of any troutcreeksoaps product, discontinue use immediately and seek appropriate medical attention. You are encouraged to report serious adverse events to us at troutcreeksoaps@gmail.com and, as required under MoCRA, serious adverse events associated with cosmetic product use may be reported to the FDA.

(f) Not Intended for Medical Use. troutcreeksoaps products are cosmetic products intended for external use only as cleansing and personal care products. No product sold by troutcreeksoaps is intended to diagnose, treat, cure, mitigate, or prevent any disease, skin condition, or medical condition. Nothing on our website or in our marketing materials constitutes medical advice. If you have a skin condition or medical condition, consult a qualified healthcare provider before using our products.

(g) External Use Only. All products are for external use only. Keep out of reach of children. Avoid contact with eyes. If product contacts eyes, rinse thoroughly with water. If irritation persists, seek medical attention.

(h) Assumption of Risk. You expressly assume all risks associated with the use of troutcreeksoaps products, including but not limited to the risk of allergic reaction, skin irritation, sensitization, and any other adverse effect. By purchasing and using our products, you acknowledge that you have reviewed all applicable ingredient information, that you are aware of your own allergies and sensitivities, and that you have made an independent and informed decision to use the product.

SECTION 5 - FDA REGULATORY COMPLIANCE NOTICE

(a) Cosmetic Classification. troutcreeksoaps products are formulated and marketed as cosmetic products or true soap products under applicable federal law. Our products are not drugs and are not intended to treat, diagnose, cure, or prevent any disease or medical condition. We do not make drug claims for any of our products.

(b) MoCRA Compliance. troutcreeksoaps operates in compliance with the Modernization of Cosmetics Regulation Act of 2022 (MoCRA) and applicable FDA regulations governing cosmetic products, including requirements for adverse event reporting, product safety substantiation, and labeling. Contact information for adverse event reporting is provided in Section 25 of these Terms.

(c) No FDA Approval. Cosmetic products are not subject to FDA premarket approval. The FDA has not evaluated, reviewed, or approved any troutcreeksoaps product for safety or efficacy. The absence of FDA approval does not indicate that a product is unsafe; it reflects the regulatory framework applicable to cosmetics as distinct from drugs.

(d) Regulatory Compliance by Customer. If you are purchasing products for resale, distribution, or use in a professional or commercial context, you are solely responsible for ensuring that your use, resale, relabeling, or distribution of troutcreeksoaps products complies with all applicable federal, state, and local laws, regulations, and requirements, including but not limited to FDA cosmetic regulations, MoCRA requirements, state cosmetic regulations, and any applicable labeling requirements.

SECTION 6 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. To use the Services, you may be asked to provide certain information, including your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is accurate, current, and complete, and that you have all rights necessary to provide such information. You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person. troutcreeksoaps reserves the right to terminate any account at any time for any reason, with or without notice.

SECTION 7 - PRODUCTS AND DESCRIPTIONS

(a) We have made reasonable efforts to provide accurate representations of our products. However, due to the handcrafted nature of our products, as described in Section 2, and due to the limitations of digital display technology, colors, textures, and appearances may differ from how they appear on your screen.

(b) We do not warrant that the appearance, quality, scent, color, size, or any other characteristic of any product will meet your expectations, match any image or description on our website, or match any prior purchase.

(c) All product descriptions, specifications, and other content are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and without notice, and to limit quantities available for purchase to any person, geographic region, or jurisdiction.

(d) We reserve the right to refuse service to anyone for any reason at any time.

SECTION 8 - ORDERS AND ACCEPTANCE

When you place an order through the Services, you are making an offer to purchase. troutcreeksoaps reserves the right to accept or decline any order for any reason at its sole discretion, including without limitation due to product unavailability, errors in product or pricing information, suspected fraud or misuse, or restrictions on orders to particular geographic regions. Your order is not accepted and no contract for sale is formed until troutcreeksoaps sends you an order confirmation. We must receive and verify your payment before your order is accepted. Please review your order carefully before submitting, as troutcreeksoaps may be unable to accommodate cancellation requests after an order is accepted. In the event that we decline, modify, or cancel an order, we will attempt to notify you using the contact information provided at the time of the order.

Your purchases are subject to return, exchange, or refund solely in accordance with our Refund Policy set forth in Section 10 of these Terms.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale, redistribution, or export, unless you have entered into a separate written wholesale or distribution agreement with troutcreeksoaps.

SECTION 9 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be confirmed in your order confirmation. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, or import charges, which will be calculated and displayed at checkout. troutcreeksoaps reserves the right to correct pricing errors at any time, including after an order has been submitted, and to cancel any order placed at an erroneous price. You agree to provide current, complete, and accurate payment information for all purchases. You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are duly authorized to use the payment method provided; (iii) charges incurred will be honored by your payment provider; and (iv) you will pay all charges incurred at posted prices, including all applicable taxes, shipping, and handling.

SECTION 10 - REFUND POLICY

If you are not satisfied with your purchase for any reason, contact us within thirty (30) days of the delivery date at troutcreeksoaps@gmail.com with your order number and a description of your experience. We will issue a full refund of the purchase price of the product at our discretion. troutcreeksoaps expressly reserves the right to refuse any refund request, in whole or in part, in its sole and absolute discretion, including without limitation in cases of suspected abuse of this policy, repeated refund requests, requests submitted outside the thirty (30) day window, requests that are inconsistent with the stated facts, suspected fraudulent claims, or requests that do not reflect a legitimate dissatisfaction with the product as received. The exercise of this discretion is final.

Natural variation in color, texture, scent, appearance, and other characteristics inherent to handcrafted products, as described in Section 2, shall not constitute grounds for a refund under this policy.

SECTION 11 - SHIPPING AND DELIVERY

troutcreeksoaps is not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather events, natural disasters, customs processing, acts of God, pandemic, governmental action, or any other circumstances outside our control. Once we transfer products to the carrier, title and risk of loss pass to you. troutcreeksoaps is not responsible for lost, stolen, or damaged packages after delivery to the carrier. Any claims for lost or damaged shipments must be made directly with the applicable shipping carrier.

SECTION 12 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, trade names, logos, product names, text, displays, images, graphics, product descriptions, video, audio, and the design, selection, and arrangement thereof, are owned by troutcreeksoaps, its affiliates, or its licensors and are protected by U.S. and foreign intellectual property laws including without limitation copyright, trademark, and trade dress laws. These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any material from the Services without our prior written consent. All rights not expressly granted herein are reserved by troutcreeksoaps.

SECTION 13 - RELATIONSHIP WITH SHOPIFY

troutcreeksoaps is powered by Shopify, which enables us to provide the Services to you. All sales and purchases made through our store are made directly with troutcreeksoaps. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any transaction between you and troutcreeksoaps, including any injury, damage, loss, or claim resulting from purchased products or services. You expressly release Shopify and its affiliates, officers, directors, employees, and agents from all claims, damages, and liabilities arising from or related to your purchases and transactions with troutcreeksoaps.

SECTION 14 - PRIVACY

All personal information collected through the Services is subject to our Privacy Policy, which is incorporated herein by reference. By using the Services, you acknowledge that you have read our Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes certain personal information about your access to and use of the Services in order to provide and improve the Services. Information you submit may be transmitted to and shared with Shopify and third parties in order to process transactions and provide the Services.

SECTION 15 - USER CONDUCT AND PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services (a) for any unlawful or fraudulent purpose; (b) to violate any applicable law or regulation; (c) to infringe upon or violate any intellectual property rights; (d) to harass, harm, defame, or intimidate any person; (e) to transmit false or misleading information; (f) to upload or transmit viruses, malware, or any other malicious code; (g) to collect or track personal information of others; (h) to use any automated means, robot, spider, scraper, or AI agent to access the Services without our express written permission; (i) to impersonate any person or entity; or (j) to engage in any conduct that restricts or inhibits anyone's use of the Services or that may harm troutcreeksoaps, Shopify, or any user. We reserve the right to terminate your access to the Services at any time, without notice, for violation of these Terms.

SECTION 16 - DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TROUTCREEKSOAPS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.

WITHOUT LIMITING THE FOREGOING: (A) TROUTCREEKSOAPS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (B) TROUTCREEKSOAPS DOES NOT WARRANT THAT ANY PRODUCT WILL MEET YOUR EXPECTATIONS, BE FREE OF DEFECTS, OR BE SUITABLE FOR ANY PARTICULAR PURPOSE; (C) TROUTCREEKSOAPS MAKES NO WARRANTY REGARDING THE RESULTS OF THE USE OF ANY PRODUCT; AND (D) ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY, BUT SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TROUTCREEKSOAPS, ITS OWNERS, OPERATORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SUPPLIERS, OR SERVICE PROVIDERS, OR THOSE OF SHOPIFY OR ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES; (B) ANY PRODUCT PURCHASED THROUGH THE SERVICES; (C) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN; (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED TO OR THROUGH THE SERVICES; OR (E) ANY CONTENT, PRODUCT, OR SERVICES OBTAINED THROUGH THE SERVICES, EVEN IF TROUTCREEKSOAPS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, TROUTCREEKSOAPS'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO TROUTCREEKSOAPS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) FIFTY DOLLARS ($50.00).

THE LIMITATIONS SET FORTH IN THIS SECTION ARE A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN TROUTCREEKSOAPS AND YOU. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU IN FULL, BUT SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

SECTION 18 - INDEMNIFICATION

You agree to defend, indemnify, and hold harmless troutcreeksoaps, Shopify, and their respective affiliates, partners, officers, directors, members, managers, employees, agents, contractors, licensors, and service providers (collectively, "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way related to: (a) your breach of these Terms or any policy or agreement incorporated by reference herein; (b) your violation of any applicable law, rule, or regulation; (c) your violation of any third-party right, including without limitation any intellectual property right, privacy right, or proprietary right; (d) your use or misuse of any product purchased from troutcreeksoaps, including use contrary to product instructions, intended use, or applicable warnings; (e) any claim by a third party arising from your acts or omissions; or (f) any content, information, or materials you submit to or through the Services.

troutcreeksoaps reserves the right, at your expense, to assume exclusive control and defense of any matter for which you are required to indemnify troutcreeksoaps, and you agree to cooperate with our defense of such claims. You agree not to settle any such matter without the prior written consent of troutcreeksoaps.

SECTION 19 - GOVERNING LAW; FORUM SELECTION; JURISDICTION

(a) Governing Law. These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any product purchased through the Services, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.

(b) Forum Selection. YOU AND TROUTCREEKSOAPS EACH AGREE THAT ANY AND ALL DISPUTES, CLAIMS, OR CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT PURCHASED THROUGH THE SERVICES SHALL BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN THE STATE OF NEW YORK. YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY SUBMIT TO THE PERSONAL JURISDICTION OF SUCH COURTS AND WAIVE ANY OBJECTION TO THE LAYING OF VENUE IN SUCH COURTS, INCLUDING ANY OBJECTION THAT SUCH COURTS ARE AN INCONVENIENT FORUM.

(c) Waiver of Jury Trial. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND TROUTCREEKSOAPS EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT PURCHASED THROUGH THE SERVICES.

(d) Class Action Waiver. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN THROUGH ANY OTHER PROCEEDING, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.
